Abstract |
Background. The collection of data on the population is becoming relevant that is facilitated by advances in digital technologies, new methods of data processing and use of artificial intelligence. In addition, automatic data processing creates additional threats to the right to privacy. The key objectives are to analyze the legal frameworks for creating databases on the population in Russia, to study the legal regime of big data, to identify the gaps in state regulation of vast data arrays, to explore foreign practices, in particular, the UK. Materials and methods. The empirical basis of the study is the legal provisions of the Federal Law dated 8 June 2020 no. 168-FZ "On the Unified Federal Information Register Containing Data on the Population of the Russian Federation", as well as the Identity Cards Act of the UK dated 30 March 2006. The comparative legal research method is used among the major ones. Results. The main characteristics of the creating unified register containing information about the population in Russia are presented, namely: ac-cumulation of data on each citizen of Russia; no blocking of access to data by the subject of information (citizen); extensive nature of data entered into the register; appointment of the Federal Tax Service as the register operator; assignment of an entry in the register for each citizen with the corresponding identifier. Conclusions. The foreign practice of creating a unified population register, which existed in the UK for about five years, is revealed. Due to the emergence of additional threats related to data leakage, it was decided to liquidate such a register and to completely eliminate its material carriers. |
